ESMA has updated its Q&As on the Prospectus Regulation with three new Q&As.

The Q&As provide clarifications on the following aspects:

  • The application of Article 4(1) of the CRA Regulation to credit rating disclosure in prospectuses;
  • How to determine home Member State in the context of global depository receipts over shares; and
  • The publication of supplements to prospectuses when new audited annual financial information is published by a non-equity issuer.

EBA has launched a public consultation on draft Regulatory Technical Standards (RTS) on a central database on anti-money laundering and countering the financing of terrorism (AML/CFT) in the EU.

The draft RTS proposed in this Consultation Paper specify the definition and the materiality of weaknesses identified by competent authorities, the type of information collected, and how such information will be communicated to the EBA. It also sets out how the EBA will analyse and disseminate the information contained in the AML/CFT central database. Moreover, the draft RTS set out the rules to ensure the effectiveness of the database, the confidentiality of the data contained in the database, as well as how the database will interact with other notifications that competent authorities are required to provide to the EBA and the provisions to ensure the protection of personal data.

This database will be a key tool for the EBA’s recently enhanced mandate to lead, coordinate and monitor AML/CFT efforts in the European Union. The consultation runs until 17 June 2021.

EIOPA has published technical information on the relevant risk free interest rate term structures (RFR) with reference to the end of April 2021.

RFR information has been calculated on the basis of the foreseen changes in the deep, liquid and transparent points and the content of the Technical Documentation published on 16 December 2020 and based on RFR coding released on 8 October 2019.

 EIOPA has published the technical information on the symmetric adjustment of the equity capital charge for Solvency II with reference to the end of April 2021.

 The International Accounting Standards Board (Board) published the Exposure Draft Lack of Exchangeability to amend the IAS 21.

The Exposure draft proposes to add requirements to IAS 21 for a company to determine whether a currency is exchangeable into another currency and the exchange rate to use when it is not.

Comments to be received by 1 September 2021.

Banca d’Italia ha aggiornato le proprie Disposizioni sulla procedura di valutazione dell’idoneità degli esponenti di banche, intermediari finanziari, istituti di moneta elettronica, istituti di pagamento e sistemi di garanzia dei depositanti

A seguito dell’adozione del decreto del MEF n. 169/2020 sui requisiti di idoneità degli esponenti delle banche e degli altri intermediari regolati dal TUB si è reso necessario aggiornare la procedura per la verifica da parte della Banca d’Italia.

Le Disposizioni, che tengono conto dei commenti ricevuti durante la consultazione pubblica chiusasi lo scorso febbraio, entrano in vigore il 1° luglio 2021 e si applicano:

  • alle nomine effettuate successivamente al 1° luglio 2021;
  • alle nomine effettuate dopo la data di entrata in vigore del decreto del MEF, ma prima del 1° luglio 2021, limitatamente agli eventi previsti dai paragrafi 3, 4, 5 e 6 della Sezione II, se successivi al 1° luglio 2021 (trattasi di (i) procedura per la valutazione dell’idoneità dei componenti supplenti dell’organo di controllo, (ii) assunzione di un incarico non esecutivo aggiuntivo, (iii) eventi sopravvenuti e rinnovi, (iv) sospensione degli incarichi)

Banca d’Italia ha pubblicato la versione aggiornata del foglio informativo relativo all’archivio informatizzato degli assegni bancari e postali e delle carte di pagamento (cosiddetta Centrale di allarme interbancaria, CAI) che costituisce un servizio di interesse economico generale finalizzato ad assicurare il regolare funzionamento del sistema dei pagamenti.
