Pubblicato in Gazzetta Ufficiale n. 266 dell’8 novembre 2021 il provvedimento di Banca d’Italia del 26 ottobre 2021 recante disposizioni sulle informazioni e i documenti da trasmettere per la presentazione dell’istanza di autorizzazione all’acquisizione di partecipazioni qualificate in banche, intermediari ai sensi dell’art. 106 del TUB, IMEL, IP, SGR, SICAV e SICAF.

Le disposizioni contengono un aggiornamento dei documenti e delle informazioni che devono essere trasmesse a Banca d’Italia dai soggetti che intendono acquisire una partecipazione qualificata in uno degli intermediari summenzionati.

Le disposizioni entrano in vigore il 1° aprile 2022 e si applicano alle istanze di autorizzazione presentate a partire da questa data.

The International Organization of Securities Commissions (IOSCO) has published a set of recommendations on sustainability-related practices, policies, procedures and disclosures in asset management.

The report focuses on investor protection issues and covers five areas:

  • Asset managers’ practices, policies, procedures and disclosures;
  • product disclosure;
  • supervisory oversight;
  • terminology;
  • financial and investor education.

In addition, the report highlights the need to address the challenges associated with the lack of reliability and comparability of ESG data and ratings provided by third-party providers to enable the investment sector to properly assess sustainability risks.

EBA has published its Final Report on draft Regulatory Technical Standards (RTS) specifying the information that crowdfunding service providers offering individual portfolio management of loans shall provide to investors in relation to the method to assess credit risk, and on each individual portfolio.

The draft RTS also specify the policies, procedures and organisational arrangements that crowdfunding service providers shall have in place in relation to any contingency fund they may offer to investors.

These RTS are the first of two mandates assigned to EBA with a view to contributing to a sound prudential and disclosure framework for crowdfunding service providers.
