ESMA is issuing a public statement on its supervisory approach to position limits for commodity derivatives.
The purpose is to clarify the application of position limits and coordinate the supervisory actions of National Competent Authorities pending the legislative change introduced by the MiFID II Recovery Package for commodity derivatives. This legislative change will start to apply in early 2022.

 

EBA published today the phase 2 of its reporting framework v3.0. The technical package supports the implementation of the reporting framework by providing standard specifications and includes the validation rules, the Data Point Model (DPM) and the XBRL taxonomies for v3.0.

The technical package covers reporting requirements on MREL/TLAC and MREL decisions and notifications on impracticability of contractual recognition of bail-in. In addition, this release includes error corrections to previous releases related to remuneration (High earners and benchmarking Report), G-SII indicators and asset encumbrance.

 

Consob has published Q&A which are useful to clarify how listed companies can establish information flows concerning information that can take on a privileged nature with the shareholders and, in particular, with the controlling shareholder.

The Q&A outline the conditions under which selective information can be considered legitimate towards the controlling shareholder and / or the shareholder who exercises management and coordination, always in compliance with the confidentiality constraints of the recipients of the information; the information flows functional to the preparation of the accounting reports are also taken into consideration as well as further hypotheses whereas an explanatory report of the selective information can be detected. Finally, the Q&A provide clarifications about the publication of the business plans, recalling that although they are not subject to specific disclosure requirements, they remain subject to the obligations of management and disclosure to the public of the privileged information contained therein.

The number of websites blacked out since July 2019 has thus risen to 405.

Pubblicato nella Gazzetta Ufficiale n. 67 del 18 marzo 2021 il decreto del Ministero dell’economia e delle finanze 22 dicembre 2020 recante disciplina dei siti web per il confronto tra le offerte relative ai conti di pagamento.

Il decreto dà attuazione unitaria alle disposizioni contenute nel decreto legislativo n. 37/2017, che attua la direttiva 2014/92/UE sulla comparabilità delle spese relative al conto di pagamento, sul trasferimento del conto di pagamento e sull’accesso al conto di pagamento con caratteristiche di base, e nella legge n. 124/2017, recante legge annuale per il mercato e la concorrenza, disciplinando in maniera univoca l’utilizzo di siti internet per la comparabilità delle spese relative ai prodotti bancari più diffusi. Il decreto entra in vigore a partire dal 19 marzo.
