The European Commission has launched a consultation on its retail investment strategy.
The consultation will collect views and information that will help the Commission to develop its policies. In line with the objective of “an economy that serves people”, the Commission wants to ensure that the legal framework for retail investment is properly adapted to the profile and needs of consumers, helps to ensure better market outcomes, increases the confidence of retail investors and enhances their participation in capital markets.
The consultation will end on 3 August 2021.
The European Central Bank, following recent clarifications regarding Regulation (EU) 2017/2402 (the securitisation Regulation), has considered that supervision concerning the requirements in Articles 6-8 of the Regulation relating to risk retention, transparency and the prohibition of resecuritisations are of a prudential nature and, therefore, within the ECB’s competence.
In the coming months the ECB will define exactly how it will carry out these supervisory tasks. It will then communicate further details on its supervisory approach and model, including the obligations for banks to inform the competent national authorities about securitisation activities.

Pubblicato nella Gazzetta Ufficiale n. 115 del 15 maggio 2021 il decreto Ministero dell’economia e delle finanze 7 maggio 2021 di definizione degli apporti al Patrimonio Destinato (c.d. Decreto Apporti). Il decreto-legge 19 maggio 2020 n. 34 (c.d. Decreto Rilancio) dispone all’art. 27 che, al fine di attuare interventi e operazioni di sostegno e rilancio del sistema economico-produttivo italiano in conseguenza dell’emergenza epidemiologica da “COVID-19”, Cassa depositi e prestiti S.p.a. è autorizzata a costituire un Patrimonio Destinato denominato “Patrimonio Rilancio”, a cui sono apportati beni e rapporti giuridici dal Ministero dell’economia e delle finanze. Il Patrimonio Destinato e ciascuno dei suoi comparti sono rispettivamente composti dai beni e dai rapporti giuridici attivi e passivi ad essi apportati, nonché dai beni e dai rapporti giuridici di tempo in tempo generati o comunque rivenienti dalla gestione delle loro rispettive risorse, ivi inclusi i mezzi finanziari e le passività rivenienti dalle operazioni di finanziamento. Il presente decreto definisce i suddetti apporti del Ministero dell’economia e delle finanze al Patrimonio Destinato.

Pubblicato nella Gazzetta Ufficiale n. 114 del 14 maggio 2021 il Regolamento IVASS 27 aprile 2021 n. 47 Regolamento recante disposizioni in materia di piani di risanamento e finanziamento di cui al Titolo XVI – Misure di salvaguardia, risanamento e liquidazione – del decreto legislativo 7 settembre 2005, n. 209 (Codice delle assicurazioni private). Il Regolamento detta in particolare disposizioni di dettaglio riguardanti il contenuto dei piani di risanamento e di finanziamento, individuali e di gruppo, in attuazione di quanto disposto dall’articolo 223-ter del Codice delle assicurazioni private (CAP). Il Regolamento disciplina altresì profili attuativi concernenti il processo di predisposizione e autorizzazione dei suddetti piani. Il Regolamento entra in vigore a partire dal 15 maggio 2021.
Ten financial authorities, including CONSOB, participating in the G-7 Cyber Expert Group (CEG) representing six G-7 jurisdictions, collaborated in developing a proposal for a common classification of malevolent cyber incidents (cyber attacks) and of other incidents concerning cyber security. The proposal is described in an Occasional Paper -“Proposal for a common categorisation of IT incidents” – in compliance of the request made by the Finance Ministers and Central Bank Governors during the G-7 Finance Track meeting in Chantilly in July 2019.
The objective of the proposal is to promote, through the definition of common principles and by the development of a shared taxonomy, the harmonization of incidents-related reports provided for by different frameworks required to financial entities by the authorities. The adoption of common principles and taxonomy would make more forceful and effective the reporting of incidents, facilitating their common understanding, the sharing of information and the joint management of cyber crises at the international level. The participating authorities took into account, in their proposal the comments made by the representatives of the respective financial sectors.
