Il 14 aprile 2022 è stato pubblicato nella G.U. della Repubblica Italiana un Provvedimento della Banca d’Italia, riguardante le notifiche dovute dagli operatori telefonici e dai soggetti che emettono strumenti cd. a spendibilità limitata, che modifica il Provvedimento dell’11 ottobre 2018 di attuazione del Titolo II del d.lgs. n. 11 del 2010.

In particolare, con l’obiettivo di semplificare gli adempimenti in capo ai destinatari del Provvedimento, viene eliminato l’obbligo, finora previsto, di effettuare una comunicazione annuale. Continua invece a sussistere l’obbligo di comunicare alla Banca d’Italia eventuali cambiamenti rispetto alle informazioni già rese e resta ferma la possibilità, per la stessa Banca d’Italia, di richiedere una nuova notifica contenente informazioni aggiornate qualora lo reputi necessario.
Con esclusivo riferimento ai soggetti che emettono strumenti cd. a spendibilità limitata, si segnala che – a seguito della  pubblicazione degli “Orientamenti EBA sull’esclusione relativa alle reti limitate a norma della direttiva relativa ai servizi di pagamento nel mercato interno”, che contengono indicazioni e chiarimenti in merito al perimetro di esclusione degli strumenti di pagamento a spendibilità limitata – le Autorità nazionali devono effettuare una nuova valutazione di tutti gli strumenti ad esse già notificati.
A tal fine, le Società già iscritte nella apposita appendice dell’albo degli Istituti di pagamento dovranno inviare alla Banca d’Italia una specifica comunicazione che illustri nuovamente l’operatività posta in essere e la sua riconducibilità al perimetro di esclusione in parola. Tale notifica potrà essere inviata nel periodo compreso tra il 1° giugno ed il 1° settembre 2022 avvalendosi del modello utilizzato in sede di prima comunicazione e non dovrà essere corredata da certificazioni. Salvo diversa comunicazione da parte della Banca d’Italia, le Società continueranno ad essere iscritte nel citato albo.
Bank of Italy has released six new Occasional Papers (nn. 686-691):
The Fundamental Review of the Trading Book (FRTB) includes higher capital charges for carbon trading under the standardized approach to market risk, which has implications for banks in their role as intermediaries in the emissions trading system (ETS).
In particular this paper extends the findings by investigating the risk of carbon certificate trading in two North American markets, the Western Climate Initiative and the Regional Greenhouse Gas Initiative, as well as the UK’s ETS.
The Report shows progress in closing MREL shortfalls, as of December 2020, which was mostly driven by largest institutions while smaller institutions lagged somewhat behind.
The aim of the public consultation is to improve IORPs reporting focusing on emerging risks and new challenges and issues observed by NCAs and pensions industry since its first implementation in 2018.
In the consultation package EIOPA proposes to amend its current Decision by including the provision of the following information:
  • Derivative information to assess actual hedging of various types of risks and how this impacts IORPs risks;
  • Cash flow information to calculate comparable and market-consistent values of IORPs’ defined benefit liabilities;
  • High-level look-through data on IORPs investments in UCITs to obtain a complete picture of IORPs assets and risk exposures;
  • Cross-border data by host country to get an accurate picture of the cross-border relationships;
  • Detail on the NACE code, allowing for better assessment of environmental, social and governance (ESG) risks.
Finally, alignment of taxonomies between reporting frameworks, where relevant, was also considered. The alignment is following the principles of the strategy on supervisory data in EU financial services  defined by the European Commission and should ultimately lead to the reduction of costs for NCAs, reporting entities and EIOPA.
The consultation will end on 18 July 2022.
