Con nota n. 25 del 16 marzo 2022, Banca d’Italia ha dato attuazione agli Orientamenti dell’EBA sulla delineazione e segnalazione dei mezzi finanziari disponibili dei sistemi di garanzia dei depositi (EBA/GL/2021/17).
Gli Orientamenti dell’EBA assumono quindi il valore di Orientamenti di vigilanza secondo quanto illustrato nella Comunicazione sulle modalità attraverso le quali la Banca d’Italia si conforma agli Orientamenti e alle Raccomandazioni delle Autorità europee di vigilanza.
Gli orientamenti si applicano ai sistemi di garanzia dei depositi ai fini della quantificazione della dotazione finanziaria utile al raggiungimento del livello-obiettivo.
Gli orientamenti sono applicabili a decorrere dal 30 marzo 2022.

L’IVASS ha posto in pubblica consultazione un Regolamento in materia di incaricati esterni per l’attività di mystery shopping per la tutela dei consumatori di cui all’articolo 144-bis del Decreto Legislativo 6 settembre 2005, n. 206 (Codice del consumo).
Le disposizioni del presente Regolamento si applicano alle attività di mystery shopping svolte nei confronti di:
- imprese di assicurazione con sede legale nel territorio della Repubblica Italiana;
- imprese di assicurazione comunitarie che svolgono la loro attività nel territorio della Repubblica Italiana in regime di stabilimento o di libera prestazione di servizi;
- sedi secondarie nel territorio della Repubblica Italiana di imprese di assicurazione con sede legale in uno Stato terzo;
- intermediari assicurativi di cui all’articolo 109, comma 2, del Codice e intermediari con residenza o sede legale in altro Stato membro che siano iscritti nell’Elenco Annesso di cui agli articoli 116-quater e 116-quinquies del Codice;
- soggetti, enti e organizzazioni che in qualunque forma svolgono funzioni parzialmente comprese nel ciclo operativo delle imprese di assicurazione limitatamente ai profili assicurativi di cui all’articolo 6, comma 1, lettera c) del Codice.
La consultazione terminerà il 15 aprile 2022.
ECB acknowledges that the proposed regulation consists of technical adjustments with the aim of operationalising substantive legislative decisions implemented by the latest amendments to Directive 2014/59/EU of the European Parliament and of the Council (BRRD), assessed in the ECB’s opinion on revisions to the Union crisis management framework.
The ECB supports the proposed regulation, which ensures better alignment between the provisions of Regulation (EU) No 575/2013 of the European Parliament and of the Council (CRR) and the provisions of the BRRD, following the entry into force of the revised framework on Total Loss-Absorbing Capacity (TLAC) and the minimum requirement for own funds and eligible liabilities.
ECB further supports the proposed regulation inasmuch as it ensures better alignment of the regulatory treatment of global systemically important institutions (G-SIIs) with a multiple point of entry (MPE) resolution strategy, including groups with subsidiaries registered in third countries, with the treatment outlined in the TLAC standard.
