The European Supervisory Authorities (ESMA, EBA, EIOPA) submitted to the European Commission draft Regulatory Technical Standards (RTS) on amendments to the key information document for PRIIPs.
Following a request from the European Commission in December 2020, EIOPA’s Board of Supervisors further analysed the draft RTS which was adopted today by a qualified majority of EIOPA’s Board.
While some national competent authorities at EIOPA’s Board continued to express reservations on the draft RTS, they supported the proposal based on the further details provided by the European Commission on their approach to the broader review of PRIIPs Regulation, namely that the review will thoroughly examine the application of the PRIIPs framework, including:
- how to achieve better alignment between PRIIPs, Insurance Distribution Directive and Markets in Financial Instruments Directive II regarding provisions on costs disclosure;
- the scope of products as foreseen by the PRIIPs Regulation;
- how to ensure that the KID contains the key information necessary for retail investors while avoiding too much or too complex information for these investors;
- how to allow the creation of a digitalised KID allowing layered information and reviewing the default paper basis of the KID, taking into account the specific challenges for different types of products (e.g. multi-option products (MOPs));
- the need for a more tailored approach, such as for MOPs, in order to maximise understanding and use of the information, while continuing to allow for comparability of similar products.
ESMA has updated its Q&A regarding market structures issues under MiFID II and MiFIR.
The Q&As provide clarification on:
- The classification of DEA trades; and
- Matched Principal Trading by investment firms.
In order to increase use of the ELTIF framework, ESMA proposes changes aimed at bringing ELTIFs more in line with the needs of investors (both retail and professional). In the letter, ESMA proposes amendments in the following areas:
- Eligible assets and investments;
- Authorisation process;
- Portfolio composition and diversification;
- Redemptions; and
- Prospectus and cost disclosure.
EIOPA published technical information on the relevant risk free interest rate term structures (RFR) with reference to the end of January 2021.
EIOPA published the technical information on the symmetric adjustment of the equity capital charge for Solvency II with reference to the end of January 2021.

Fatturazione elettronica: in Gazzetta Ufficiale le norme tecniche per la fatturazione automatica
È stato pubblicato in Gazzetta Ufficiale n. 27 il Decreto 12 dicembre 2020 della Presidenza del Consiglio dei ministri sulla definizione delle regole tecniche del servizio di fatturazione automatica relativamente alla parte sulla fatturazione elettronica.
Le soluzioni tecnologiche adottate hanno come scopo:
- la realizzazione di un sistema centralizzato che semplifica lo scambio di informazioni fra i soggetti coinvolti in una transazione commerciale che prevede l’emissione della fattura elettronica;
- la realizzazione di un sistema fruibile a richiesta anche da parte di coloro che effettuano acquisti al di fuori dell’esercizio dell’attività di impresa, dell’esercizio di un’arte o di una professione;
- l’incentivazione della digitalizzazione dei pagamenti tramite l’utilizzo di carte e strumenti di pagamento tracciabili presso esercenti residenti o stabiliti nel territorio dello Stato;
- la possibilità di sfruttare l’evoluzione delle tecnologie già in uso, quali, tra le altre, l’adeguamento dei sistemi di cassa.
Il servizio di fatturazione automatica di cui al presente decreto si applica alle operazioni di pagamento effettuate presso POS presenti sul territorio nazionale, effettuate mediante l’utilizzo di carte di debito, carte di credito, carte prepagate, ivi inclusi gli strumenti di pagamento di cui all’art. 2, comma 2, lettera m), del decreto legislativo 27 gennaio 2010, n. 11, nonché tramite applicazioni che consentono di effettuare bonifici di pagamento o tramite altri sistemi di pagamento messi a disposizione presso punti vendita presenti sul territorio nazionale. Sono escluse dall’ambito di applicazione del presente decreto le transazioni di pagamento effettuate presso ATM.
