Assosim ha pubblicato l’aggiornamento delle proprie Linee guida per la predisposizione del modello organizzativo ai sensi del D.Lgs. 231/2001.
La nuova versione delle Linee guida, approvata dal Ministero della Giustizia nel gennaio scorso, si sviluppa in tre differenti sezioni:

  1. una Parte Generale, che contiene la descrizione della normativa di cui al D.Lgs. 231/2001, dei contenuti del modello 231 e dell’attività dell’Organismo di Vigilanza;
  2. una Parte Speciale, contenente una serie di schede relative alle categorie di reati presupposto previste dal D.Lgs. 231/2001; e
  3. un Allegato, che descrive, con riferimento alle singole categorie di reati presupposto, alcuni esempi di attività sensibili e di relativi protocolli utili agli Associati per la redazione dei modelli organizzativi.
The new regulation specifies the content, methodology and presentation of the information to be disclosed, to guarantee its quality and comparability. Under the new regulatory technical framework, financial market participants will be able to disclose detailed information on how to deal with and reduce the potential negative impacts of their investments on the environment and society in general.
The new disclosure requirements also make it possible a further assessment of the sustainability performance of financial products and – consequently – strengthen investor protection and reduce  greenwashing.
The regulatory technical standards will be examined by the European Parliament and the Council, to be applied from 1 st January 2023.
In the Opinion the EBA expresses its disagreement with two substantive changes proposed by the Commission and agrees with the other amendments, which are considered non-substantive.
The two substantive changes are related to:
  1. the provisions covering the notions of direct and indirect funding; and
  2. the prior permission process for certain types of liquidation entities.
