Con Comunicato Stampa del 31 marzo 2022, Banca d’Italia ha pubblicato i dati utili per la determinazione dei tassi di riferimento relativamente alle operazioni di credito agevolato da stipularsi nel mese di aprile 2022:

  • per quanto riguarda il rendimento medio ponderato riferito all’anno commerciale dei BOT a sei mesi e a dodici mesi, relativo al mese di marzo 2022, il valore da considerare è pari a -0,460;
  • per quanto riguarda la media mensile dei rendimenti lordi dei titoli pubblici soggetti a tassazione, relativa al mese di febbraio 2022, il valore da considerare è pari a 1,170.

Banca d’Italia ha pubblicato i tassi di interesse effettivi globali medi (TEGM) applicati nel quarto trimestre 2021 dagli intermediari, rilevati su delega del Ministero dell’Economia e delle Finanze ai sensi della Legge n.108/96 (antiusura) in base alle categorie omogenee di operazioni definite annualmente dal MEF stesso.

I valori medi derivanti dalla rilevazione statistica periodica, corretti per le eventuali variazioni dei tassi sulle operazioni di politica monetaria successive al trimestre di riferimento, costituiscono la base per il calcolo dei “tassi soglia”. Questi ultimi rappresentano il limite oltre il quale gli interessi sono considerati “usurari”, da chiunque pretesi o incassati (art.644, comma 3 del codice penale, Legge n.108/1996, art.2).

Pubblicata nella Gazzetta Ufficiale n. 77 del 1° aprile 2022 la delibera Consob del 24 marzo 2022 n. 22274 che modifica il Regolamento Emittenti per l’adeguamento agli orientamenti ESMA34-39-992 in materia di commissioni di performance degli OICVM e di alcuni tipi di FIA.

Le modifiche al Regolamento emittenti sono state effettuate:

  • integrando nell’articolo 15-bis il contenuto del KIID (Key Information Document) per i risparmiatori, con le informazioni per l’inserimento di un “prominent warning” che metta in luce che le commissioni di performance sono addebitabili al fondo anche in caso di performance negativa e delle informazioni sulla commissione di performance;
  • modificando lo Schema 1 dell’Allegato 1B al medesimo Regolamento.

ESMA  is postponing the annual review of the regulatory technical standards – RTS 2 – on non-equity transparency.

The decision was taken because the on-going MiFIR review is likely to have a significant impact on the instruments subject to this report.

RTS 2 requires that ESMA performs an annual review by 30 July, assessing whether it is appropriate to move to the next stage of the phase-in for the liquidity determination of bonds, and the trade percentiles determining the pre-trade sizes specific to the financial instrument (SSTI) threshold for bonds and derivatives.

ESMA decided not to perform this year’s annual report, which would have been the third report, given that the on-going MiFIR review is likely to make part of the review redundant due to the proposed removal of the SSTI threshold, and might impact other provisions related to the instruments subject to this report.

Moreover, since the previous step of the phase-in is still being implemented, it would not be possible to assess the impact of moving to the next stage based on transaction data.

ESMA will resume the submission of the annual RTS 2 report in 2023.

ESMA  has updated the following Q&A:

ESMA has published new Guidelines on certain aspects of remuneration policies and practices under Directive 2014/65/EU (MiFID II).
The purpose of these guidelines is to enhance clarity and foster convergence in the implementation of certain aspects of the new MiFID II remuneration requirements, replacing the existing ESMA guidelines on the same topic, issued in 2013.
In particular, ESMA highlights that the remuneration of staff involved in the provision of investment and ancillary services and activities, or in selling or advising on structured deposits to clients is a crucial issue for investor protection.
