The Peer Review published gives further insight into the supervisory approaches adopted by NCAs when authorising relocating firms in the scope of Brexit. It should be noted that Brexit was an exceptional, one-off event, which created uncertainty and was complex to handle for market participants and NCAs alike.
Key findingsin the report:
- NCAs allowed in certain cases for an extensive use of outsourcing/delegation arrangements; and
- Several firms relocated with limited technical and human resources in the EU. In particular, NCAs applied different interpretations of proportionality when it came to substance requirements. This led in certain cases to some smaller firms relocating with only very minimal set-ups.
The report is accompanied by the publication of the 2022 EU-wide transparency exercise, which provides detailed information, in a comparable and accessible format, for 122 banks across 26 EEA / EU countries.
Banks should prepare for a likely deterioration in asset quality and strengthen their screening systems and controls to ensure a strict compliance with sanctions to prevent legal and reputational risks.
