Le modifiche riguardano principalmente il bilancio consolidato delle banche a capo di conglomerati con attività a prevalenza nel settore bancario nonché quello di banche che hanno partecipazioni in imprese di assicurazione consolidate contabilmente e che non sono a capo di conglomerati.
Al fine di contenere gli oneri di compilazione per le banche, nella predisposizione dell’aggiornamento si è tenuto conto delle disposizioni recentemente emanate dall’IVASS con riferimento al bilancio assicurativo IAS/IFRS.
In particolare, è previsto un rinvio alle disposizioni emanate dall’IVASS per gli aspetti riconducibili ai contratti assicurativi di pertinenza delle imprese di assicurazione incluse nel consolidamento.
I principali aspetti di novità introdotti riguardano l’adeguamento degli schemi del bilancio consolidato e della relativa informativa di nota integrativa alle previsioni dell’IFRS 17, che hanno modificato lo IAS 1 e l’IFRS 7, e l’allineamento alle disposizioni emanate dall’IVASS.
L’aggiornamento si applica a partire dai bilanci chiusi o in corso al 31 dicembre 2023.
ESMA is seeking input on the review of the technical standards under Article 34 of the Markets in Financial Instruments Directive (MiFID II), covering the provision of investment services across the EU.
The main amendments proposed add the following items to the information that investment firms are required to provide at the passporting stage:
- the marketing means the firm will use in host Member States;
- the language(s) for which the investment firm has the necessary arrangements to deal with complaints from clients from each of the host Member States in which it provides services;
- in which Member States the firm will actively use its passport as well as the categories of clients targeted; and
- the investment firm’s internal organisation in relation to the cross-border activities of the firm.
The consultation closes on 17 February 2023.
ESMA has published two Final Reports including guidelines on the central counterparties (CCPs) Resolution Regime under the CCP Recovery and Resolution Regulation (CCPRRR):
- The Guidelines on the assessment of resolvability set out common aspects to be assessed by resolution authorities when evaluating the extent to which a CCP may be resolved without relying on certain types of external financial support, including public financial support or central bank assistance.
- The Guidelines on the cooperation arrangements specify provisions to be included in cooperation arrangements that shall be entered into between competent or resolution authorities and third-country authorities. These arrangements relate to EU CCPs that provide services to clearing members and clients located in third countries as well as to third-country CCPs that provide services to clearing members and their EU-based clients.
