Banca d’Italia ha comunicato i Tassi Effettivi Globali Medi (TEGM) applicati nel secondo trimestre 2021 dagli intermediari, che costituiscono la base per il calcolo dei “tassi soglia”. Questi rappresentano il limite oltre il quale gli interessi sono considerati usurari ai sensi dell’art.644, comma 3 del codice penale, e dell’art. 2 della Legge n.108/1996.
La tabella dei TEGM è stata trasmessa al MEF che la pubblicherà nella Gazzetta Ufficiale mediante un apposito Decreto, contenente anche le “soglie di usura” valide per il quarto trimestre 2021.

EBA has launched its regular EU-wide transparency exercise, whose results are expected to be published at the beginning of December. The exercise is exclusively based on supervisory reporting data, which will keep the burden for the banks to a minimum. Transparency exercises are conducted on an annual basis and are part of the EBA’s efforts to monitor risks and vulnerabilities and to reinforce market discipline.
The data will cover capital positions, profitability, financial assets, risk exposure amounts, sovereign exposures and asset quality. This year the EBA will provide additional pieces of information on the exposures under EBA compliant moratoria and public guarantee schemes, which will allow public to have more comprehensive assessment of the impact of the COVID-19 crisis on the banking sector.
The report also identifies issues which will be followed up by ESMA via amendments to ESMA technical standards or additional guidance on a number of topics. Those includes:
- the concepts of “algorithmic trading” and “Direct Electronic Access”;
- the authorisation regime for EU and non-EU algorithmic trading firms (including HFT firms) deploying their strategies on EU trading venues;
- the organisational requirements for investment firms, including the notification and testing requirements of algorithmic traders to competent authorities; and, the self-assessment exercises to be performed by investment firms;
- organisational requirements for trading venues, including the self-assessment exercises to be performed by trading venues, circuit breakers, the fee structures, order to trade ratios; and market outages; and
- a review of MiFID II provisions which are indirectly relating to algorithmic trading activities (e.g. tick size and market making).
