With Notice of 7 July 2021, Consob announced its intention to comply with the Guidelines issued by ESMA on certain aspects of the MiFID II requirements relating to the compliance function.

These guidelines provide operational guidance on the role and responsibilities of the compliance function within the internal control system.

Intermediaries subject to Consob supervision are required to comply with the interpretative guidelines issued by ESMA through the Guidelines that are the subject of this notice, applicable, according to the terms set out in paragraphs 3 and 4 of the Guidelines, as of 7 June 2021, replacing the previous ones issued under the MiFID I regulatory framework.

With Delegated Regulation (EU) 2021/962, published in the Official Journal of the European Union on 16 June 2021, the transitional period referred to in Article 89(1) of the EMIR Regulation (EU Regulation 648/2012) on the exemption to the clearing obligation for OTC derivatives was extended to 18 June 2022.

Published in the Official Journal of the European Union of 8 July 2021 the Commission Delegated Regulation (EU) 2021/1118 of 26 March 2021 supplementing Directive 2014/59/EU of the European Parliament and of the Council, as regards regulatory technical standards specifying the methodology to be used by resolution authorities to estimate the requirement under Article 104a of Directive 2013/36/EU of the European Parliament and of the Council and the combined buffer requirement for entities under resolution at the level of the group under resolution on a consolidated basis if the group under resolution is not subject to those requirements under that Directive.

The European Banking Authority (EBA) published today phase 2 of its 3.1 reporting framework. The technical package supports the implementation of the reporting framework by providing standard specifications and includes the validation rules, the Data Point Model (DPM) and the XBRL taxonomies for version 3.1.

In particular, the technical package covers the new reporting requirements that include the amendments to the supervisory benchmarking and resolution planning frameworks. The DPM Query Tool has also been updated to reflect the current release.
