ESMA has published its final report providing technical advice to the European Commission on the supervisory fees charged to credit rating agencies (CRAs). The report is based on feedback from the recent public consultation and proposes changes to the calculation and the collection of supervisory fees set out in the current Delegated Regulation.
ESMA proposes to charge:
- a fixed registration fee of €40,000; and
- an annual supervisory fee of 0.5% of turnover to CRAs with annual revenues of between €4,000,000-15,000,000.
The proposed changes will ensure that ESMA meets the regulatory obligation to charge fees that cover its costs whilst remaining proportionate to the revenues of the firms supervised. ESMA also recommends a number of changes to streamline the fee collection process and to align ESMA’s approach across its supervisory mandates. These include the requirement for supervisory fees to be paid in a single instalment in the first quarter of the financial year to ensure that ESMA has funds available for its ongoing supervision.
The technical advice has been sent to the European Commission and will feed into the upcoming review of the Delegated Regulation.
This note summarizes the policy options examined at international and EU level to reform the regulatory framework for money market funds (MMFs) and presents some preliminary considerations. The note first discusses the main vulnerabilities of MMFs and the liquidity strains experienced during the market turmoil in March 2020. It then provides a summary of the ongoing international work to address fragilities in the MMF sector and related policy proposals. Finally, it proposes some high-level principles that could guide the discussion and the selection of potential policy reforms for addressing vulnerabilities in the MMF sector.

Il regolamento disciplina da parte dell’Autorità l’esercizio del potere sanzionatorio previsto dall’art. 19, comma 5, del decreto-legge 24 giugno 2014, n. 90 (“Misure urgenti per la semplificazione e la trasparenza amministrativa e per l’efficienza degli uffici giudiziari”).
L’Autorità avvia il procedimento per l’irrogazione delle sanzioni di cui al presente regolamento d’ufficio, nei casi in cui, nel corso di accertamenti o ispezioni, siano emersi comportamenti configurabili come ipotesi di omessa adozione, ovvero sulla base di segnalazioni pervenute.
Nel caso di segnalazioni gravemente incomplete o palesemente infondate il responsabile del procedimento dispone il mancato avvio del procedimento, informandone il Consiglio attraverso una notizia riassuntiva trimestrale. Qualora i soggetti interessati ne facciano richiesta, l’Autorità dà comunicazione del mancato avvio del procedimento.

Il presente regolamento disciplina il procedimento sanzionatorio per l’irrogazione, da parte dell’Autorità, delle sanzioni di cui all’art. 47 del decreto legislativo 14 marzo 2013, n. 33 e dell’art. 19 del decreto legislativo 19 agosto 2016, n. 175 (Testo unico in materia di società a partecipazione pubblica).
Il regolamento sostituisce ed abroga il regolamento adottato dall’Autorità il 15 luglio 2015, pubblicato nella Gazzetta Ufficiale n. 176 del 31 luglio 2015 e si applica anche agli illeciti posti in essere prima della sua entrata in vigore, per i quali non sono stati ancora trasmessi gli atti al Prefetto ai sensi dell’art. 9 del regolamento del 15 luglio 2015 da ultimo indicato.
