ESMA has published the Final Report on Guidelines on the calculation of positions in SFTs by Trade Repositories (TRs) under the SFTR.

The Guidelines aim to ensure consistency of position calculation across TRs, with regard to the time of calculations, the scope of the data used in calculations, the data preparation, the recordkeeping of data and the calculation methodologies. They contain relevant clarifications to Trade Repositories (TRs) as to:

  • the calculations carried out by TRs and the format of provision of access to data pursuant to Article 80(4) of EMIR as referred to in Article 5(2) of SFTR and detailed under Article 5 of RTS on data aggregation
  • the level of access to positions provided by TRs to the entities included in Article 12(2) of SFTR with access to positions in line with Article 3 of RTS on data access.

EBA has published its final draft Regulatory Technical Standards (RTS) on own funds and eligible liabilities.

The draft RTS align existing provisions to changes introduced in the revised CRR in the area of own funds. This is the case, in particular, for provisions relating to the regime of supervisory prior permission for the reduction of own funds.

In addition, the draft RTS specify some of the newly introduced criteria for eligible liabilities instruments derived from the own funds regime. These include the absence of direct or indirect funding for the acquisition of ownership of eligible liabilities, the absence of incentives to redeem, the need for the resolution authority’s prior permission for the reduction of eligible liabilities. For some of these aspects, the mandates attributed to the EBA explicitly require to ensure full alignment between eligible liabilities and own funds.

Following the feedback received during the public consultation, the calibration of the threshold for determining the predetermined amount for the general prior permission for reducing eligible liabilities instruments was increased from 3% to 10% of the total amount of outstanding eligible liabilities instruments. Moreover, the final draft RTS have been revised in order to recognise some relief for the renewal of general prior permission both for own funds and eligible liabilities and for introducing a proportionate approach for liquidation entities for which their minimum requirement for own funds and eligible liabilities (MREL) does not exceed the loss absorption amount.

The European Payments Council has put out for public consultation a proposal to amend its Rulebook on SEPA Request to Pay (SRTP), aimed at regulating the payment of invoices, goods/services in physical/online shops and P2P transfers. In particular, the purpose of the consultation is to standardise and digitise the notice of a payment request from the creditor to the debtor.

The consultation will end on 27 August 2021.

International Association of Insurance Supervisors has published an application Paper on the Supervision of Climate-related Risks in the Insurance Sector

This Application Paper aims to support supervisors in their efforts to integrate climate risk considerations into the supervision of the insurance sector. It provides background and guidance on how the IAIS supervisory material can be used to manage the challenges and opportunities arising from climate-related risks. Application Papers do not establish standards or expectations, but instead provide additional guidance to assist implementation and provide examples of good practice. This Paper thereby also aims to promote a globally consistent approach to addressing climate-related risks in the supervision of the insurance sector. This, however, is an iterative and dynamic process given that the understanding of the challenges and opportunities presented by climate-related risks will improve and evolve as the guidance provided is increasingly embedded in supervisory practices.

È stato pubblicato in Gazzetta Ufficiale n. 23 del 25 maggio 2021, il Decreto legge 25 maggio 2021, n. 73 (Decreto Sostegni-bis), recante misure urgenti connesse all’emergenza da Covid-19, per le imprese, il lavoro, i giovani, la salute e i servizi territoriali.

In particolare, le misure adottate si articolano su 7 principali linee di azione:

  • sostegno alle imprese, all’economia e abbattimento dei costi fissi;
  • accesso al credito e liquidità delle imprese;
  • tutela della salute;
  • lavoro e politiche sociali;
  • sostegno agli enti territoriali;
  • giovani, scuola e ricerca;
  • misure di carattere settoriale.

Il Decreto entra in vigore a partire dal 26 maggio 2021.

Pubblicato in Gazzetta Ufficiale n. 123 del 25 maggio 2021, il Decreto 18 maggio 2021 del Ministero dell’Economia e delle Finanze (MEF) recante l’emissione del decreto operatività Repo maggio 2021, contenente l’emissione dei buoni del Tesoro poliennali.

Il Decreto prevede l’avvio dal 24 maggio 2021 del Repo, per il quale il MEF effettuerà una emissione ad hoc di tranche di titoli di Stato finalizzata alla costituzione di un proprio portafoglio titoli da utilizzare esclusivamente nelle operazioni Repo. In particolare, per la costituzione di detto portafoglio, l’ammontare in circolazione di ciascun BTP incluso nello stesso portafoglio sarà incrementato di un importo pari a 1.000 milioni di euro, tenendo conto che l’importo complessivo del portafoglio titoli finalizzato unicamente alle operazioni Repo sarà pari a 15.000 milioni di euro.

Le operazioni saranno garantite da Cassa Compensazione e Garanzia mentre le operazioni di custodia dei titoli e di liquidazione delle operazioni saranno svolte da Monte Titoli.
