IVASS has launched a public consultation the draft regulation laying down provisions relating to the reporting of data and information on non-life premiums collected by undertakings through individual intermediaries and through directorate activities.

The consultation will end on 28 February 2022.

Published in the Official Journal of the European Union of 31 January 2022 the Decision (EU) 2022/134 Of the European Central Bank of 19 January 2022 laying down common rules on the transmission by the European Central Bank of supervisory information to authorities and bodies for the purpose of carrying out the tasks conferred on it by Council Regulation (EU) No 1024/2013.

This Decision establishes common rules on the transmission of supervisory information held by the ECB to authorities and bodies.

The common rules laid down in this Decision should be without prejudice to the provisions of other instruments that lay down specific rules on particular categories of transmission of supervisory information to authorities and bodies.

 

ESMA has launched a public consultation on a targeted revision to its Guidelines and Recommendations on the Scope of the CRA Regulation (Regulation (CE) No. 1060/2009).

The proposed revision is intended to provide greater clarity on the exemptions for private ratings under the CRA Regulation, and addresses the following key elements of private credit ratings:

  • the interpretation of the terms “produced pursuant to an individual order” and “provided exclusively to the person who placed the order”;
  • restrictions on sharing a private credit rating with a “limited number of third parties”; and
  • how to monitor the distribution of private credit ratings by the ratings producer

The consultation will end on 11 March 2022.

ESMA has launched a consultation paper (CP) on what constitutes a multilateral system.

The CP also provides guidance on concrete examples, where the trading venue perimeter is not easily identified and might be subject to different interpretations from market participants and national competent authorities.

This consultation follows up on the final report on the functioning of Organised Trading Facilities under MiFID II in which ESMA committed to publish an opinion clarifying the definition of multilateral systems and providing guidance on when systems should be considered as multilateral systems and, in consequence, seek for authorisation as trading venues.

The proposed Opinion intends to enhance supervisory convergence in the EU and to level the playing field between market participants.

The consultation will end on 29 April 2022.

ESMA has updated the following Q&A:

EIOPA has launched  a second survey concerning the Pan-European Personal Pension Product (PEPP).

The aim of this survey is to gauge and better understand the potential take-up of PEPP by eligible providers (asset managers, insurance undertakings, IORPs and credit institutions, including banks).

The consultation will end on 28 February 2022.

EIOPA has launched a public consultation on retail investor protection in relation to the sale of Insurance-Based Investment Products (IBIPs).

EIOPA presents its proposals in five different areas in the consultation paper:

  1. Enhancing consumer engagement with disclosures, including digital disclosures;
  2. Assessing the risks and opportunities presented by new digital tools & channels;
  3. Tackling damaging conflicts of interest in the sales process;
  4. Promotion of an affordable and efficient sales process;
  5. Assessing the impact of complexity in the retail investment product market.

The consultation will end on 25 February 2022.

The three European Supervisory Authorities (EBA, ESMA and EIOPA, jointly ESAs) published today a Joint ESAs thematic repository on financial education and digitalisation initiatives of National Competent Authorities, with a specific focus on cybersecurity, scams and fraud.

The repository contains 127 national initiatives that provide consumers with helpful information on how to improve their financial literacy.
