The Bank of Italy has started the activities to collect the data for the calculation of the 2022 ex-ante contributions to the Single Resolution Fund (SRF); the calculation of the contributions will be performed by the Single Resolution Board (SRB).

Italian intermediaries falling within the scope of the SRF are required to send to the Bank of Italy the data for the calculation since 3rd November 2021 to 20th December 2021, in accordance with the instructions transmitted to the contributing institutions by the Bank of Italy.

Borsa Italiana with Notice No. 33487 of 8 October 2021 published amendments to the Market Rules and related instructions: Admission requirements related to AIFs; Fine tuning definition Reverse Merger; Euronext MIV Milan Market: extension of NAV-anchored trading mode to Retail AIFs; Third Country Auditors.

The amendments will enter into force on 25 October 2021.

Borsa Italiana with Notice No. 33488 of 8 October 2021 published the amendments to the Regulations of the ExtraMOT Market of the ExtraMOT PRO3 Segment and of the SeDeX Market: Information Obligations of Issuers.

The amendments will enter into force on 25 October 2021.

Il Dipartimento del Tesoro del Ministero dell’Economica e delle finanze ha posto in pubblica consultazione lo schema di decreto recante norme in materia di registro dei soggetti convenzionati ed agenti di prestatori di servizi di pagamento e istituti emittenti moneta elettronica, in attuazione dell’art. 45, comma 3, del decreto legislativo 21 novembre 2007, n. 231.

Il nuovo registro sarà tenuto e gestito dall’Organismo degli agenti in attività finanziaria e dei mediatori creditizi (OAM).

La previsione del registro si inserisce tra i presidi diretti alla prevenzione del riciclaggio e del finanziamento del terrorismo al fine di assicurare un più efficace e immediato controllo sulla regolarità dell’esercizio dell’attività dei soggetti convenzionati e degli agenti di cui i prestatori di servizi di pagamento e gli istituti di moneta elettronica, ivi compresi quelli aventi sede legale e amministrazione centrale in altro Stato membro, si avvalgono per l’esercizio della propria attività sul territorio della Repubblica.

Il registro prevede inoltre una apposita sezione nella quale sono iscritti i punti di contatto centrale di cui si avvalgono i prestatori di servizi di pagamento e gli istituti di moneta elettronica aventi sede legale e amministrazione centrale in altro Stato comunitario.

Lo schema di decreto che viene posto in consultazione è costituto da 9 articoli che disciplinano:

  • l’oggetto e le finalità dell’intervento normativo;
  • le modalità e le tempistiche di alimentazione e consultazione del registro e della sezione ad accesso riservato dello stesso;
  • le modalità di alimentazione della sezione dedicata ai punti di contatto centrale;
  • le modalità di determinazione del contributo per l’istituzione, lo sviluppo e la gestione del registro;
  • le specifiche tecniche delle procedure di registrazione, accreditamento e consultazione del registro.

La consultazione terminerà il 5 novembre 2021.

EIOPA has published its second “Failures and near misses in insurance” report.

The report takes stock of the most common courses of action taken by insurers and national competent authorities (NCAs) during the recovery and resolution phases of failures and near misses. The database underpinning the report pools valuable information about the impact of the various measures implemented, which serve to improve supervisory knowledge in the fields of failure prevention and the reduction of eventual losses.

The findings of the report lend further support to EIOPA’s views on the need for a common recovery and resolution framework at the EU level and for a minimum degree of harmonisation across the network of national IGSs (insurance guarantee scheme) to minimise the impact of failures and better protect policyholders.
